”Erbjud patienten vård där patienten vill”

Lyckligtvis för patienterna och regionerna finns det redan ett regelverk för vård inom och utom regionen som alla patienter har rätt att utnyttja. Det kallas vård inom EU + EES och den vården får vilken patient som helst använda sig av enligt vägledande domar i det svenska rättssystemet.

2007 meddelade i Kammarrätten i Stockholm ett prejudicerande domslut med målnummer 3482-07.

Och väntetidslagen gäller omedelbart. Patienten har rätt att omedelbart när den söker vård eller får en remiss själv besluta var patienten själv tror att den kan få bästa vården inom EU + EES, inklusive den egna regionen. Och VSS gäller i hela EU + EES inom öppen eller sluten vård, inom privat eller offentlig vård på precis samma sätt som inom den egna regionen.

Regionerna synes sakna kunskap om EU:s rättighetsstadga, EURS, som Sverige som ordförandeland i EU skrev under 2009 att gälla som svensk lag. Om en förordning strider mot EU-rätten så gäller Regeringsformen, tolfte kapitlet tionde paragrafen, om att den svenska förordningen då inte får användas.

Detta innebär att en region som är klok erbjuder den enskilda patienten med sin VSS att söka inom öppen eller sluten vård, inom privat eller offentlig vård, till vilket land inom EU + EES som patienten önskar. Då blir det en plats ledig i kön som kan erbjudas den patient som inte vill åka utomregionalt.

Kostnaden för regionen blir i stort oförändrad, VSS ligger som en skuld till regionen tills patienten har fått den önskade vården. Som biverkan kommer både regionen och samhället att vinna på kortare väntetider, färre onödiga extrabesök under väntetiden och kortare sjukskrivningar.

Nu är det upp till bevis att regionerna följer de lagar och förordningar som redan finns. Erbjud patienten vård där patienten vill! Det tjänar alla på.
